Cherokee Grey Wolf 22rr axle/pipe clearance

Any input would be appreciated. I recently bought a brand new 2016 Grey Wolf 22rr from a dealership in the midwest. I towed it back to NY. The very first time I went to use it, we discovered that the gray water discharge pipe was broken. It had made contact with the axle and the elbow snapped right off. The rapair went through and when I picked it up, the same tank/plumbing had been used as a replacement. The new pipe only sits 3/4" above the floating axle and even less space 1/4" when parked on a slight incline. My fear is that I'm gonna have the same problem again and again if they dont re-plumb the tank and plumbing a different way. Any opinions would be helpful....I have more emails and calls into FR. Please see attached pics. One while level and the other on a slight side to side grade.

Yeah that is close... If it happened once it will happen again I would guess.

Diffrent trailer (26dbh) but I did an axle flip to get clearance. Check your wheel wells.. Mine rubbed bad I there as well.
