My trailer weighs the same as the op's and when I had my 2500 the drive axles had 5700 lbs on them loaded with the trailer. I was under all weight ratings.

Thanks for the replies, info, and opinions. I APPRECIATE IT!!! And the bantering back and forth is fun to follow. Bottom line, before I pull the trigger on this thing, I need to get it and my truck to a CAT scale. Even with it "dry" I should have a pretty good idea on where I'm at. I know how much we typically load into the camper (we've had a tt for 4 years). It's those nice large basement storage areas that'll screw me on weight as I'll love to load it up with crap!

So let's say you have a $1,000,000 damage accident, and your rig is found by the insurance company to have been operating in excess of GVWR, max allowed 5th wheel pin weight, or max 5th wheel towing weight. Do you think they are going to pay your claim or represent you in any court action that your accident incurred?

They are not that dumb. Insurance companies have banks of lawyers whose only job is to ensure the company only pays claims that they cannot find an excuse to avoid.

And you think the insurance company is going to pick up all the pieces and weight them. Pretty hard to prove that all the debris was in your truck/trailer.

I'm not sure what you trying to say - are saying if you get wreck just make sure your RV is in pieces so they can't weight it. What happens if you not successful in totally destroying your RV and they can weight it. Hmmm

Out of all the RV's, horse/cattle trailers, goose necks etc.and there have been many crashes...does anyone know or have personal experience that can be verified of times when insurance companies refused claims or they were sued....heck the weights y'all are talking about are peanuts compared to some of the ranch trucks and contractors that are hauling in excess of 20k lbs...is it safe or legal....probably not...but happens all the time here in Texas...but I have never heard of anyone being sued or claims not paid.....course that don't mean it hasn't happened... But I am pretty old and been round the block a few times....

I think you will find that over weight won't make to court but be setting out court. There are lawyers that take these cases and even advertise for them like this one. Philadelphia Recreational Vehicle (RV) Accident Lawyer There must be something to it.

We are no fault state so insurance will always pay but like in DUI case the insurance company can sue and recoup claim cost in damages.

I just think you are blowing smoke! Post an actual occurrence that this has actually happened. In my 75+ yrs, I've never heard of such an occurrence as you described ever happening.

I would think pulling an 8,000+ lb trailer with a Durango would be hard to argue about not being over weight. If I had a wreck pulling a 5er with a VW Jetta, it would be a gimmy for any insurance company. The exception, not the rule.

Doesn't say they were overloaded as determined in a lawsuit. Have heard of and seen some crashes caused by vehicles towing trailers, just not of a lawsuit as you described.

I not a expert in law nor do I give legal advice but might want call this person and ask them about since they specialize in overweight RVs. Quoted from the site.

My neighbor down the street has got that overloaded trailer story web link beat with his setup. He doesn't even have tow mirrors on his F150 shortbed (does NOT have max tow package or max payload package) that he uses to tow a 35 foot along with his wife and 3 children in the truck. His vehicle is only rated to tow 9800 lbs and I'm sure he is at or over his max payload capacity of 1700 lbs. Did I mention he has P rated tires too?

When I see his camper parked in front of the house for a weekend getaway, I always ask where he is going so I can stay clear of any roads he might be on that day.

When I sold my XLT F150 Ecoboost for a bigger truck, I offered to give him my clip on tow mirrors for free and he declined saying he didn't need them.

I hope Darwin doesn't get a hold of him or any innocents.

Getting back to the towing question. Please rely on the people using this forum. Although controversial at times they will tell you the straight scoop.
What ever you do DO NOT RELY ON THE RV DEALER WHO TELLS YOU " WITH THAT TRUCK YOU CAN HANDLE ANYTHING ON THIS LOT " Lots of help here and its FREE. Just my 0.02 worth.

the scary part is, there are thousands more out there just like him. Figure just because it moves and sort of stops, it must be OK.
