I believe it's not a fault because it's doing what it's asked and the circuits are intact. It's a simple misadjustment. The switch is threaded and if you screw it a turn or two counterclockwise it ensures the switch is off/open all the way when released. Again, the cruise circuit is also doing what it's asked because it sees the brake circuit is on and shuts the cruise off like it's suppose to.
I've seen this on Dodge trucks quite often too.
