Oddly enough, about 10 minutes after posting today, FR responded. They are still "investigating:, but feel that axles may have been swapped for lighter ones. ( are you kidding me?) I replied by resending the axle tag picture showing manufacture in 1/ 05. This would work out right for a model year 06 trailer. The tag inside showing GVW, shows CCC of approx 4274 lbs. In shopping online, I estimate cost to make this right, of approx. 2000-2500 dollars in parts. I think small claims in Ma. is limited to 2000, but not sure. It seems to me that they are risking much more liability if this thing fails and hurts someone, not to mention the "customer satisfaction" price. This is not a warranty issue of a component failure, but a build error, that has been wrong since it rolled off the line. Also in reading other forums, this is not an unheard of issue. I fully expect them to "weasel" out of this, but I am not letting it go.Thanks for your interest and feedback. Will update as I know anything.
