Once a company accepts payment for an item or service, they have to provide that item or service that they promised at the price given. They can't take your money and two weeks later say it's going to cost more. That in effect is exactly what is going on with his situation. Even though they are refunding him, they are still saying that it's going to cost more for the same product that they sold him for less. If it costs they more it's there fault for not keeping up on prices. I work at an FBO at an airport and if we say we will sell fuel or hanger rent at a certain price, we can't sell it at a higher price even IF we loose money.

If the situation were reversed and the OP wanted to cancel the order because he changed his mind, he would probably not be so adamant that the sale constituted a contract. Everyone makes mistakes and the OP has not really been harmed. I assume credit was given in the same credit card bill cycle so no economic harm occurred. We live in a way too litigious society! OP should feel fortunate to have not experienced real fraud that actually harmed him.

Buyers are allowed to cancel, sometimes with a fee. BUT the seller can't automatically refund the the buyers money because the distributor was out of stock. That just means that your product is delayed in getting to you. The op has a case and should persure until the seller does the right thing or gets there fines as they should.

I have done this on occasion when things didn't get shipped as stated. Called Citi Bank Credit Cards or on line and dispute the charge. There is an option that allows you so say item not shipped as promised. They then will credit your account until resolved. They do the leg work for you. Discover Card, Visa and Master Card Holders can do this.

Don't shoot the messenger, but there is a lot of misinformation being spread in this thread, especially about what is legal or not. Ethical and legal are not the same, nor can be enforced the same.

You will find out that just about any merchant doing business online will have a disclaimer about pricing errors...and they can cancel the sale before shipping (but not necessarily before charging your credit card) if discovered.

As a buyer, you may not like it, but there isn't really anything you can "legally" do about it beside telling the rest of the world. Many businesses who operate on a reputation standard, with do what is best and may try to honor a previous price even if it's wrong. This is just good customer service and smart for repeat business, but it's not legally required they do it.

Don't believe me? Case in point, and one of the best internet companies there is.....Amazon.

Sorry for the delay in getting back on this topic but here is the final outcome.


The hitch they had advertised and I paid for was discontinued by B&W. They had not changed or updated this model on the site to reflect the new model for the hitch. B&W basically made the hitch (Patriot 16k with welded base) an 18K and no longer offered the welded base in 16K. The website still had the 16K hitch displayed with the higher price.


We traded emails and they wound up offering the 18K Patriot to me at cost, they realized my efforts for getting to the bottom of the situation. I thought this was admiral and a good business decision.


I am paying a little more for the 18K hitch and only really need the 16K (I think I am grossing around 15K on my rig), but the welded base and overall hitch looks stronger and will be better to be over rated than right at it.


I will try and edit this topic to reflect that RvPartsCountry.com made things right.

Glad they had explained why they did what they did. Would have made everything far less painful if they had said that in the beginning. In the end they stepped up and tried to make you happy.

Update on RvPartsCountry.com

Long story short I did not purchase from them due to the fact we still had issues with refund and overall communications.

I wound up turning them in to the BBB in their home state. They responded to my complaint and I had the opportunity to respond to that. This was the first time for me to ever contact a BBB so I wasn't sure of what to expect.

I was asked of my expectations from the complaint. I of course wanted my refund and I also said I hoped other customers did not have to deal with the troubles I had faced.

I felt the main problem was lack of customer service and communications with the customer (pretty much one and the same). The BBB closed the complaint when I received my refund so I wasn't sure if my perseverance paid off any more than me just getting my money.

I am still on a newsletter list from them and I received this a couple days ago:



We are very excited to let you know that our customer service has advanced to serve you quicker. Please visit our support center by clicking on Customer Service at the Top of our Website.




They did listen to me and made some changes to the way they conducted business. I pushed some by contacting the BBB, but the end result is they have a better process in place for contacting them with any thing besides a purchase.

I feel good about the process and knowing that if you feel strongly about something or feel that you where wronged...do something about it!

I bought an air conditioner cover from them and they sent me a charcoal grille.They have a terrible return policy and you can only contact them via email.So imagine how it was trying to explain this mess over email and get the wrong part returned.It took a month and a letter to the better business people to get me a cover.I even called and was told the manager would call me back and never did.they suck i will never buy from them again!!
