I have to assume the rig was passing on the left as he was gaining on the truck in the right lane and had previously moved over to the left to go around before the video started. The Car was at fault for not merging with a safe distance. Sometimes people in cars don't think about how hard it is to slow down a 10 ton truck. he was also getting pushed into the guided rail before deciding to come back onto the road. Those of us who haul a trailer only knows about 1/4 of the weight a rig needs to deal with. Lesson learned, merge cautiously and think about the drivers around you. And don't take a chance on vehicles bigger than you

Yes platokidd. Other things can contribute to the cause. Distracted/unattentive drivers are a major factor in many accidents. Not seeing a light turn red, not seeing a stop sign, veering into incoming traffic, etc. In my experience of 33 years, the courts would rule here that talking on the phone didn't cause the accident. The aggressive driver of the vw came in to the truck's lane when it wasn't safe to do so. Basically not being on the phone would not have prevented the traffic violation committed by the vw driver. But with today's courts and law translations, who knows what they would determine. Lol. Glad I'm retired now.

Exactly. The only thing that the law grants right of way to is pedestrian. The rest of the time, it stipulated who must yield right of way.

Vehicles are never 'granted' right of way.

I am in law enforcement and from Canada, however I doubt the laws in the US would be much different so pending any extra facts of the case, the car driver would be at fault for making an unsafe lane change, the truck driver would have been in an unsafe position to hit his brakes and possibly creating a "Jackknife condition". For defensive driver training when towing a trailer is to drive though and not to do a panic move of "Stomping on the brakes" which at highway speed would create chaos. But in a case like this you would have a tech out to re-create the scene by determing veh speeds by tire marks etc. From what we saw, luckily there was not a casualty. Of course once you hire lawyers anything can happen. As they say....investigate, write the ticket and move on.

It WAS a 2011 Subaru Forester.

My experience in the military is two 5 or 10 ton trucks taking out a jeep or two Leopard tanks rolling over something. My worst was responding to a pedestrian or motorcycle accident.....there is the bike....there is the driver...and where is the helmet.

No idea about the commercial but I can tell you that the guy that was driving the Subaru survived.

Took them an hour or so to get him out.
