The owner's story doesn't make sense. He listed the rig for sale on-line as "Deleted", but claims that he got the truck that way saying, "I didn't know anything about this; I didn't know that was a thing."

...and rather than restore the emissions, his solution is to junk the motor or take it to the truck pull and possibly blow it up? The guy is a moron!

I think he means that he didn't think that reselling a deleted truck would be a violation of anything. Personally, I would have no idea that this was a thing either. If I bought a truck that already had emission mods/deletes, I wouldn't think that listing it for resale would be a problem. I'd be just as surprised as this guy. Of course, I wouldn't buy a vehicle that someone modified in that manner, mainly because I'd be concerned about how that would affect reliability (maybe it has no effect, who knows)

Now, his solution... Well, doesn't make much sense to me either. But to each their own.

I'd consider it bragging as many folks want to buy one that is already deleted so it is a selling point.

Folks (and used car dealers) sell deleted used trucks around here all the time. It would be harder to find a non-deleted used diesel.

Doesn't it depend on the State you are selling it if it's illegal or not?

I'm not 100% sure, but I believe that tampering with emissions equipment is illegal at the federal level. Its just that they don't normally go after individuals. It appears that at least one state will though.

Guess I am glad I never deleted mine but it is a pain. They need to make the system more reliable. I am installing my third DEF heater right now.

There are stories of the EPA raiding diesel shops who they suspect of emissions tampering due to advertisements and word of mouth. In turn, they seize customer records and send out letters of non-compliance to the owners. It has happened here in Anchorage. According to the news reports the EPA's concern is with vehicles gas or diesel less than 20 years old. If your rig is older than that they don't bother you. Our big 3 dealerships will not service rigs that have undergone emissions tampering. Hard to tell what the dealerships will do in the event of a tampered trade-in?

AFAIK, tampering and deleting emissions is a federal offense.
Dont ask, dont tell when selling and buying contraband.
Washoe county requires an annual diesel smog check to register in NV.

I would argue that listing the vehicle as deleted is simply a disclosure. This would let a prospective buyer know that repairs would be needed. Much as if the engine was blown or in the case of a house that needed repairs to be brought up to code. it allows the buyer to compute the costs for repairs into their offer.
I say that because of the disclosure that the vehicle was in need of repair, that he was not in violation of NJAC 7:27-14.3(E)2

Further the NJAC section is not a criminal code. The Dept of Environmental Protection letter clearly states, "This notice does not constitute a formal administrative order, a final agency action or a final legal determination that a violation has occurred."

Yes. Others who have said no are incorrect. Some states it is completely illegal to remove the scrubbers and sell them that way with no regulation.

And while it is 'illegal' in all states due to the EPA being federal, some states/counties could care less about deleting diesels or selling them. Happens in all the states around me all the time.

This is true. The issue is that the states will be the most likely enforcement via local, county, and state police. If you are in a state that does not enforce the law, as I do, it doesn't hamper people from doing it. I wish there was better enforcement for environment sake, but I also wonder how much of a difference it make, on the whole, on non-commercial trucks at 1 ton or less rating.

Deleted diesels have more power, better mpg, and are much more dependable. I just wish the EPA would figure out a better method than the emissions garbage they hang on them now.
