Hello all, Have water coming out this valve at the top when I back flush the black water tank (tank is empty)is the valve bad? Is this a vacuum breaker?

Assuming your photo is rotated 90º. Yes, the top of that valve is a disk/flapper vacuum breaker that is supposed to seal off the opening to ambient when water pressure is applied and allow the valve cavity to drain backout input hose when pressure is removed. Sounds like it is not sealing very well.
