But does the 'stop sale' apply to the RV dealer or just the MB dealer? I think the RV dealer CAN sell...if the buyer wants to buy...

Again, its gray areas. Legally speaking a dealer is not supposed to delivery a coach with an active recall. Even a dealer that takes in a used car, if its not their brand, is bound by that.

Thank you. That helps me deal with them. I'm not certain they will start to 'push' me, but if they do, I will stand my ground...all the while hoping that the recall remedy arrives soon!

Is your unit quarantined at the RV Dealer or at the manufacturing facility - mine is at the manufacturing facility, ordered last September, build started at the end of January

I got a 2nd phone call from MB last Friday. All they said is we are working on it and parts available soon. I asked what soon is, and they did not give me a good answer. MB said this will not be like air bag recall. I just want some dates at this point. Forest River makes it sound like they are waiting on another letter from MB to tell them what to do. Those with 2022 chaises will be getting their RVs before us.

Did they give you any answer, or just "We don't have a timeframe yet" kind of response? If they don't have a timeframe, how can they say "soon"???? I think they know exactly when the parts will be available and they just don't want to promise anything. Meanwhile, the NHTSA website still says, "Recall Status: Recall Incomplete, remedy not yet available."
If it is "soon", it could mean 1 month or 3 months. I'm hopeful "soon" doesn't mean more than 3 months.

I went to our local MB dealer emailed the MB Service Rep. gave him our vin # and asked him when will the recall be corrected, his answer was 3rd quarter of 2022. He then called the MB Rep and asked him what 3rd quarter off 2022 really meant and was told August - September.
I guess no RV'ing this summer!

Please tell me that's not correct!!! I was hoping that the latest would be July, based on bclemens earlier post. I guess I'm going to be using my old RV for the rest of the summer while I wait on my new one...

This is bad news..."Mercedes-Benz is recalling more than 292,000 GL-, ML-, and R-Class SUVs from the 2006 through 2012 model years because of a potential problem with the brakes. Owners of vehicles included in the recall should not drive them until the free recall repair has been performed."
MB has bigger problems than just 2,153 torsion bars to replace. The recall announced two days ago is a 'stop drive' recall on almost 300,000 SUVs. All of them have to be towed to a MB dealership and repaired. I don't think MB gives a flip about our little problem...

So I have reached out to NHTSA via email to find out if FR falls under "manufacturer" or "dealer" as described in the recall. I have asked them if FR can legally sale the vehicle. I am also wondering if legal counsel could help benefit to resolve or seek concessions.

Not sure FR will ship even if NHTSA says it's OK. Will be interesting to find out...

NHTSA replied: "We interpret 30012 in the same fashion and would not advise Forest River to deliver any vehicle that has an unremedied safety recall. A dealership can be heavily fined for retailing vehicles with open recalls (a violation of the Motor Vehicle Safety Act)."
