Sprinter DEF lawsuit?

Received some paperwork to register for a Gov vs MB lawsuit payout.

Any ideas on what this is or what the "payout " would be?

Isn't worth the effort for $10.00 , but if large enough it might be.

These days its hard to tell what is real, vs just another scam.

I've never paid to join a class action suit. Sometimes I've received a paltry check for a suit I didn't even know was happening. This sounds like a scam, but I don't own a MB so I'm really not in the know about their issues.

If not a scam, Govt vs MB sounds more legitimate than mass tort law firm vs MB.

Was this a mail or email solicitation? How do they want the money? If they want you to send the money by wire, western union, or purchase gift cards then it is probably a scam. Check the email from address, if it is a generic address (i.e. yahoo, gmail,etc) or from your email provider(i.e. att, charter, comcast, etc.) then it is probably a scam.
I have been a party to many class actions and never once did they ask for money from me.

I have never known the US Government to initiate a class action lawsuit. Those are done by trial lawyers. Easy enough to check the validity of the filing with the District Courts. Sounds like a scam to me where they say that in order to participate you have to provide a bank account number for direct deposit of funds once settled.

Just as an aside, regarding the class action suit mentioned in the article, another site discussing the class action reports that, "Class Counsel will apply for an award of attorneys’ fees in the amount of $80,200,000, plus up to $3,200,000 in expenses."

Cases like that make it easy to pass tort "reform" laws to the detriment of the majority of lawsuits which are actually small dollars and very often justifiable.

Government agency. IE- EPA, which is more than likely what is going on here. Same as the VW lawsuit several years ago, just another OEM trying to get around the laws.

Read it again, Ffred. I have been in a bunch of these, and what the paperwork usually says is equivalent to "You are already in this lawsuit. If you think you can do better hiring your own lawyers, fill out the paperwork to opt out. Otherwise, just sit back and wait, and when it's over we will send you a check."

In this case, they will also tell you when you can make an appointment to get the hardware and firmware updates for the vehicle.

I got the letter ... it prompted me to call MB (my chassis is a 2016 on my Forrester).

They have an open campaign to swap out the NOx sensor (as part of the settlement for this lawsuit) and it flagged 6 other open recalls while we're at it.

The lawsuit basically makes them replace the sensor, reimburse anybody that had to pay to have it installed previously, and it will extend your warranty. As part of the settlement CURRENT OWNERS can get up to $3590 and past owners $897.50

I'm sure amounts will vary based on how many people are involved.

I scheduled our rig to go in to MB on the 15th and then once the AEM ("approved emissions modification" is what they call it) is performed and I have the paperwork, then I can fill out the claim and see where this goes.

It's a dual thing. The first is a recall on the emission systems which can be done free of charge at an authorized MB center that services sprinters. The second is a class-action lawsuit, but you have to have the recall completed by October 1 to be eligible.

If you are the original owner, you should have received the recall and class action information both in the mail and email (if your email address is registered with MB).

If you are not the original owner or didn't get the recall info your MB dealer can provide.

By the way, you may have also received a recall on the rear wheel sensor, but no one has the parts yet.

This is the 4th recall on this vehicle which is really irritating, not only for lost time in the shop but my authorized show is a 270-mile round trip.

I am sitting in a MB Dealer waiting room right now while my 2016 Isata 3 is being done. It is free of charge and they swap out some Emission Components depending what they find. Mostly AEM, Nox Sensors and possibly the entire Exhaust System. Takes a while as the Exhaust has to cool down for several hours before they do the work. Once done you can file with the Class Action. The biggest part in my opinion is this will extend the Warranty on Emissions and many other Major Components to 10 years or 120K miles from when originally put in service. It appears if you are the original owner you can receive up to $3,590 and former owners up to $897. It is all in the documentation. In order to get anything you must get the Emission Modification and sign onto the Class and send paperwork proving the Emission work was done by Nov 2022. This is an actual Recall Campaign by Mercedes Benz apparently brought on by the class action of United States District Court for New Jersey. I live in CA and they seem to be playing a large part of it but seems to be country wide. Applies to multiple MB vehicles but 2010-2016 MB and Freightliner Sprinters (6 Cylinder) are the ones we are concerned with.

The lawyers get all the money.................................... I was in one with Cub Cadet over hp ratings I think the payout per person was less than $1.
